The adorable, chubby crew known as Pudgy Penguins is suddenly in hot water. PEI Licensing, the powerhouse behind the classic Original Penguin clothing line, has dropped a lawsuit claiming Pudgy Penguins crossed the line with trademark infringement, dilution, and unfair competition.
Filed just days ago in a Florida federal court, the case zeroes in on Pudgy Penguins’ booming apparel game. PEI argues the project’s lineup of penguin-themed gear features a “family of penguin trademarks” that look way too similar to their iconic ones, potentially confusing shoppers everywhere.
PEI didn’t hold back in the complaint, stating, “This whole mess stems from Pudgy Penguins’ unauthorized use and push to register various PENGUIN word and design marks tied to apparel and related stuff marks that are confusingly similar to our long-standing, federally registered, and super-famous PENGUIN and penguin design trademarks.”
Pudgy Penguins has built a massive following with its cute, waddling characters turning into everything from NFTs to plush toys and streetwear. But PEI points out they’ve been rocking the “PENGUIN” word mark since at least 1967, with penguin designs hitting apparel as far back as 1956. That’s decades of history they’re defending.
Back in October 2023, PEI sent the Penguins a warning letter that the products were infringing and diluting their famous PENGUIN marks. They also demanded Pudgy Penguins drop certain trademark applications with the US Patent and Trademark Office. According to the lawsuit, those warnings went unheeded.
PEI claims Pudgy Penguins has “misappropriated valuable property rights,” creating a real risk of confusion among consumers who might mix up the two penguin worlds.
They’re asking the court to block Pudgy Penguins’ trademark apps, halt any further alleged infringement, force destruction of confusing products, and hand over profits from those sales.
On the flip side, Pudgy Penguins legal head Jennifer McGlone shared with reporters that the team was caught off guard, especially since both sides had been chatting privately to sort things out amicably.
She pushed back hard, saying, “We’re confident PEI’s claims don’t hold water. The trademarks at issue are visually distinct and target completely different crowds and markets.” McGlone added that Pudgy Penguins has already locked in multiple USPTO approvals for their brand and related marks, giving them strong footing to fight this.
The crew even dropped a cheeky meme on X, basically shrugging off any real similarities between their vibe and the classic Original Penguin look.
This clash pits a legacy fashion brand against one of crypto’s most playful success stories. Will this whole scenario go down with a quiet settlement or blow into courtroom drama? I guess we will have to wait and see.
